Welcome to Fexa AI. These Terms of Service constitute a legally binding agreement between you ("Client") and **GENISOFT** ("Provider"), governing your use of the Fexa AI platform.
1. Service Description
Fexa AI is a B2B SaaS platform designed to automate SEO content generation and translation for PrestaShop e-commerce stores. It uses artificial intelligence to assist merchants in optimizing their catalogs.
2. Account & Usage
You must be a registered business entity to use Fexa AI. You are responsible for maintaining the confidentiality of your API keys and bridge files. GENISOFT cannot be held liable for unauthorized access resulting from your failure to secure your credentials.
3. Intellectual Property
- Platform: The Fexa AI software, algorithms, and interface remain the exclusive property of GENISOFT.
- Generated Content: You retain full ownership of all content (text, meta tags, translations) generated by Fexa AI for your store. You are free to use, modify, and publish this content without restriction.
4. Disclaimer on AI Content
Fexa AI utilizes advanced Language Models to generate content. While we strive for accuracy and "human-like" quality grounded in your catalog data, **GENISOFT does not guarantee the factual accuracy or legal compliance** of the generated text. You acknowledge that AI output should be reviewed before publication.
5. Subscription & Billing
Services are billed on a subscription or credit basis. Payments are processed securely via Stripe. Refunds are handled on a case-by-case basis in accordance with consumer protection laws, though B2B transactions are generally non-refundable once services are rendered.
5 bis. Right of Withdrawal (Consumers)
If you subscribe as a consumer within the meaning of French consumer law, you normally have a 14-day right of withdrawal from the conclusion of the contract (art. L221-18 of the Code de la consommation).
However, Fexa AI is a digital service whose performance begins immediately upon subscription. By subscribing and starting to use the service (e.g. running a scan, generating or applying content) before the end of the 14-day period, you expressly request immediate performance and acknowledge that you thereby waive your right of withdrawal once the service has been fully performed, in accordance with art. L221-28, 3° and 13° of the Code de la consommation. Your explicit consent to this waiver is collected at checkout.
6. Limitation of Liability
To the maximum extent permitted by law, GENISOFT shall not be liable for any indirect, incidental, or consequential damages arising from the use of Fexa AI, including but not limited to temporary downtime, SEO ranking fluctuations, or data loss.
7. Governing Law
These Terms are governed by the laws of **France**. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Paris.
